Copyright & DMCA Policy

1. Introduction

Prizd respects the intellectual property rights of others and expects its users to do the same. This Copyright Policy outlines how we handle claims of copyright infringement in accordance with the United States Digital Millennium Copyright Act (DMCA) and Japanese copyright law.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please follow the procedures described below.

2. DMCA Takedown Procedure

If you believe that content hosted on Prizd infringes your copyright, you may submit a notification pursuant to the DMCA (17 U.S.C. § 512(c)(3)) to our designated agent. Your notification must include the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., a URL).
  • Your contact information, including your name, address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Upon receipt of a valid notification, we will act expeditiously to remove or disable access to the allegedly infringing material and will notify the user who posted it.

3. Counter-Notification

If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Prizd may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action within 10 business days, we will restore the removed material.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Prizd has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. Prizd may also, at its sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

We consider the following factors when determining repeat infringement:

  • The number of valid DMCA takedown notices received against a user.
  • Whether the user has submitted valid counter-notifications.
  • The nature and severity of the infringement.
  • Whether the user has taken steps to prevent further infringement.
